By requesting
a BuyinGold – GivinCash kit by phone or via online ordering,
you, the customer agree to the following terms
Requirements:
Every customer must be 18 years or older and is acting as the lawful
owner of any item sent to BuyinGold-GivinCash. It is BuyinGold-GivinCash’s
sole discretion to ask for proof or ownership (ID, Drivers License,
receipts, etc), if needed.
Verbal
Offers:
Any offer BuyinGold-GivinCash makes will be recorded and emailed to
our customers. Once our customer accepts the offer, immediate payment
will be made by customer’s choice (paypal, wire transfer, western
union, company check). Once payment is received our customer relinquishes
ownership of said item and BuyinGold-GivinCash will process the metal
to its refined state.
Guaranty
Against Loss:
BuyinGold-GivinCash will guaranty against loss the total contents
properly shipped to BuyinGold-GivinCash up to $100.00, the amount
BuyinGold-GivinCash provides from their prepaid envelope. BuyinGold-GivinCash
reserves the right to reject delivery of any mail which appears to
be damaged, opened, or otherwise tampered with. Any such mail will
be returned to the customer. BuyinGold-GivinCash will have no liability
to any customer for any such attempted delivery or return of any such
items. If you believe your gold is worth more than $100.00 we recommend
that you insure your shipment for more at your own expense.
Limitation
of Liability:
This limitation of liability shall be binding on each and every customer
and any third party, limited to, the customer and the customer’s
successors, assigns, insurance carriers and any entity asserting any
right or claim relating to the customer’s transaction with BuyinGold-GivinCash
.
In no event shall BuyinGold-GivinCash be liable to any third party,
including any insurance carrier. BuyinGold-GivinCash shall not be
liable for any subrogation claim brought by the customer’s insurance
carrier, and by submitting BuyinGold-GivinCash, customer expressly
and specifically waives any such subrogation claim on his or her behalf
as well as on the behalf of his or her insurance carrier.
BuyinGold-GivinCash’s liability:
is and shall be expressly and specifically limited to the least of
the following sums:
1.
The liquidation value placed on the total contents by BuyinGold-GivinCash’s
sole discretion
2. One third (1/3) of the appraised value of the contents according
to an appraisal was issued prior to the shipment of the item to BuyinGold-GivinCash
3. The sum of One Hundred Dollars ($100.00)
The
customer/seller expressly acknowledges and agrees that if there is
no appraisal which the contents being submitted to BuyinGold-GivinCash,
BuyinGold-GivinCash’s liquidated value shall be conclusive and
further, that in no event shall BuyinGold-GivinCash’sliability
exceed One Hundred Dollars ($100.00).
BuyinGold-GivinCash shall not be liable to anyone for any damages,
including but not limited to, incidental, punative, loss or profit
or opportunity, other than as set forth herein above.
Material
Return:
If you are unhappy with the quote for the items you sent us, There
will be a $15.00 shipping and handling charge to send it back to you
the customer. Please allow up to 30 days to receive your package.
